臺灣海峽⻑久以來不僅是⼀條地理上的海上通道，更是⼀條攸關全球航運、經貿交流與文化互動的重要海上⾛廊。近年
來，隨著各⽅對海域管轄權主張⽇益加劇、未達武裝衝突⾨
檻的灰⾊地帶⾏動持續增加，以及國際法秩序⾯臨愈來愈⼤的挑戰，臺灣海峽已逐漸成為印太地區最具戰略與法律重要性的海域之⼀。在此情勢下，如何透過嚴謹、以法治為基礎且強調國際合作的法律回應，以維護區域和平與海洋秩序，已成為當前國際社會共同關注的重要課題。
本論文集所收錄之論文涵蓋多項彼此關聯的重要議題，包
括：國內法與國際海洋法規範之間的不⼀致、航⾏⾃由所⾯臨的挑戰、利⽤法律戰、海上⺠兵及海警⼒量推進擴張性海洋主張的作法，以及理念相近夥伴之間在資訊共享、政策協調及外交合作⽅⾯⽇益提升的重要性。這些研究共同彰顯，法律分析不僅是學術研究的重要⼯作，更是維護國家主權、保障海上⼈類安全、防⽌脅迫⾏為常態化，並維繫國際關係法治秩序的重要⼯具。
